In 2000, California passed the Substance Abuse and Crime Prevention Act, which is also known as Proposition 36. California state law now allows defendants in nonviolent drug possession cases to participate in rehabilitation programs rather than spending time in jail.
We will refer clients to rehabilitation programs that can provide them with the personal help they need to break drug habits. The court may look favorably on defendants who have shown a desire to reform their habits. If your drug crimes case does not involve other charges, participating in a rehabilitation program may help you avoid time in jail.
